This Waiver, Release, and Assumption of Risk ("Waiver") must be read, completed, and agreed to by every participant upon initial registration with The Oasis Institute ("Oasis," "we," or "us"). This Waiver takes effect on the consent date and continues in effect for as long as the participant remains registered with Oasis, covering that participant's participation in any and all programs, classes, activities, and events offered by Oasis (each, a "Program"), whether occurring now or in the future, unless and until revoked in writing as described in Section 6. A separate consent is not required for each individual Program. If you are registering on behalf of another person, you represent that you are authorized to do so and that the terms below apply to that person as well as to you.

ASSUMPTION OF RISK

I understand that participation in this Program may involve physical activity, movement, exercise, travel, use of equipment, or other activities that carry inherent risks. These risks may include, without limitation, muscle strains, sprains, falls, cardiovascular events, injury from equipment or facility conditions, and aggravation of pre-existing medical conditions. I understand these risks exist whether or not they are specifically listed here.

I confirm that I am voluntarily participating in this Program and that I am solely responsible for evaluating my own physical condition and fitness to participate. If I have any medical condition, physical limitation, or concern that could affect my ability to safely participate, I will disclose it to Oasis staff before the Program begins and, if appropriate, consult my physician before participating.

RELEASE OF LIABILITY

In consideration for being permitted to participate in this Program, I, on behalf of myself, my heirs, personal representatives, and assigns, release, waive, discharge, and covenant not to sue The Oasis Institute, its affiliates, officers, directors, employees, volunteers, contractors, and agents (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in this Program, or while on the premises where the Program is being conducted, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, to the fullest extent permitted by applicable law.

This release does not apply to claims arising from the gross negligence, recklessness, or intentional misconduct of the Released Parties, to the extent such claims cannot lawfully be released under applicable state law.

MEDICAL AUTHORIZATION

In the event of an injury or medical emergency during the Program, I authorize Oasis staff or volunteers to contact emergency medical services and my emergency contact listed above. I authorize Oasis to arrange for emergency medical treatment on my behalf if I am unable to communicate my wishes, and I agree that I am responsible for any costs associated with such treatment.

PHOTO, VIDEO, AND MEDIA RELEASE (OPTIONAL)

From time to time, Oasis may photograph or video-record Program activities for use in newsletters, marketing materials, social media, or its website.

GENERAL PROVISIONS

• Entire Agreement. This Waiver constitutes the entire agreement between the participant and Oasis regarding the subject matter herein and supersedes any prior oral or written understandings.
• Severability. If any provision of this Waiver is found to be unenforceable, the remaining provisions will remain in full force and effect.
• Governing Law. This Waiver shall be governed by the laws of the State of Missouri, without regard to conflict-of-law principles, unless a particular Program takes place in another state, in which case the law of that state shall apply to participation in that Program.
• Duration and Scope. This Waiver takes effect as of the date signed and remains in effect for all Programs in which the participant enrolls or participates, whether before, on, or after that date, for as long as the participant is registered with Oasis. It is not limited to a single class, session, or event.
• Revocation or Updates. A participant may revoke this Waiver at any time by delivering written notice to Oasis; revocation is effective for Programs occurring after Oasis's receipt of the notice and does not affect the validity of this Waiver for participation that already occurred. Oasis may also update the terms of this Waiver from time to time and will provide the updated version to participants; continued participation in Programs after such notice constitutes acceptance of the updated terms.
• Voluntary and Informed. I have read this Waiver in its entirety, understand its terms, and sign it voluntarily and with full knowledge of its significance.

ACKNOWLEDGMENT 

I HAVE READ THIS WAIVER, RELEASE, AND ASSUMPTION OF RISK. I UNDERSTAND THAT IT APPLIES TO ALL OASIS PROGRAMS I PARTICIPATE IN, NOW AND IN THE FUTURE, FOR AS LONG AS I AM REGISTERED WITH OASIS, AND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I CONSENT VOLUNTARILY.
